THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED, AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
1Our Legal Duty
BioForge LLC is required by law to protect the privacy of your protected health information, to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect. We are also subject to the Florida Digital Bill of Rights, which treats health data as sensitive personal data.
2How We May Use And Disclose Your Information Without Your Authorization
- Treatment. To provide, coordinate and manage your care. For example, sending a prescription to a licensed pharmacy, sending an order to a laboratory, or sharing your protocol with a clinician you have asked us to involve.
- Payment. To obtain payment for services. Because BioForge is cash-pay, this is limited and does not involve insurance claims.
- Health care operations. Quality review, clinician supervision, training, business planning and audit.
- Business associates. Vendors who perform services for us and who are bound by a written agreement to protect your information, including our electronic health record, our secure messaging and fax providers, and our payment processor.
- As required by law. Including reporting abuse, neglect or domestic violence; responding to a court order or subpoena; public health reporting; reporting adverse events to the FDA; health oversight activities; and law enforcement requests that the law requires us to honor.
- To avert a serious threat to health or safety.
3Uses That Always Require Your Written Authorization
- Most uses and disclosures of psychotherapy notes.
- Use or disclosure for marketing.
- Any sale of your protected health information.
- Photographs used in advertising, testimonials or social media. BioForge asks for photography consent separately, and it is always optional.
- Any other use not described in this notice.
You may revoke an authorization in writing at any time. Revocation does not undo disclosures already made in reliance on it.
4Your Rights
- Access. You may inspect and obtain a copy of your record, including an electronic copy, generally within 30 days. A reasonable, cost-based fee may apply.
- Amendment. You may ask us to correct information you believe is wrong or incomplete. We may deny the request and will tell you why in writing.
- Accounting of disclosures. You may request a list of certain disclosures we made in the six years before your request.
- Restrictions. You may ask us to restrict how we use or disclose your information. We are not required to agree, except that we must agree to withhold information from a health plan where you paid in full out of pocket. Since BioForge is cash-pay, that applies to everything we do for you.
- Confidential communications. You may ask us to contact you a particular way or at a particular address.
- Paper copy. You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.
- Breach notification. You will be notified if a breach compromises the privacy or security of your information.
- Choice on communications. You may withdraw consent to email or text contact at any time without affecting your care.
5Complaints
If you believe your privacy rights have been violated, contact our Privacy Officer at privacy@bioforge.health or (305) 330-9519. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, 200 Independence Avenue SW, Washington, D.C. 20201, or at hhs.gov/ocr. We will not retaliate against you for filing a complaint, and filing one will not affect your care.
6Changes To This Notice
We may change this notice and apply the change to information we already hold. The current version will always be available on request and in the patient portal, with its effective date shown.
7Acknowledgment Of Receipt
By signing below I acknowledge that I have received and had the opportunity to read the BioForge LLC Notice of Privacy Practices. My signature acknowledges receipt only. It is not consent to any use or disclosure beyond what this notice and the law permit, and it does not waive any of my rights.
